Outreach Console is an email marketing and automation platform that enables users to create, send, and track email campaigns. The Service includes features for contact management, email templates, sequences, analytics, and related functionality.

3. Account Registration

  • Maintain the security of your password and account
  • Promptly update your account information if it changes

5. Email Compliance Requirements

You are solely responsible for ensuring your email campaigns comply with all applicable laws and regulations, including:

  • CAN-SPAM Act (United States)
  • CASL (Canada)
  • GDPR (European Union)
  • Other applicable anti-spam and privacy laws

This includes obtaining proper consent, including unsubscribe links, and honoring opt-out requests within the required timeframes.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Outreach Console and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you create or upload to the Service.

7. Payment Terms

For paid subscriptions:

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law or as expressly stated
  • We may change pricing with 30 days' notice before your next billing cycle
  • Failure to pay may result in suspension or termination of your account

8. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and associated data after a reasonable period
  • You may request export of your data before termination takes effect

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTREACH CONSOLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Outreach Console, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Outreach Console is incorporated, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
